Co-defendants charged with harboring and concealing Ballow from arrest

(HOUSTON) – A federal grand jury returned two separate but related indictments Oct. 26, 2010, against Harris Dempsey “Butch” Ballow, 67, formerly of Galveston County, Texas, and a total of nine other alleged associates arising from an alleged fraudulent stock sale scheme executed while Ballow was a fugitive from justice as well as charges arising from harboring and hindering Ballow’s arrest and assisting an offender, United States Attorney José Angel Moreno announced today along with FBI Special Agent in Charge Richard C. Powers and acting United States Marshal Elizabeth Saenz.

A Galveston County fugitive captured in Mexico this week after he was accused of making millions in stock scams was indicted by a Houston federal grand jury Thursday on two new charges of conspiracy and wire fraud, the U.S. Attorney's Office said.

Harris Dempsey "Butch" Ballow, 67, a former Tiki Island resident, remains in custody in Mexico City awaiting extradition to Texas. He had been a fugitive from justice for more than five years until he was captured Tuesday night.

After pleading guilty in a Houston federal courtroom in 2003 to one charge of money laundering, he jumped bond in late 2004 before his sentencing and fled the country. At that time, he could have faced as much as 10 years in prison and a $500,000 fine.

Continuing to trade
During his years on the run, Ballow continued to remain involved in public securities markets, according to the indictment returned Thursday. The indictment accuses Ballow of using pseudonyms to take control of publicly traded U.S. corporations and selling stock to investors without revealing his true identity, his past convictions or his fugitive status. Those companies included E-SOL International Corporation, Medra Corporation, Deep Earth Resources Inc. and Aztec Technology Partners Inc. — now called Ultimate Lifestyles Corporation.

Ballow is accused of selling "millions of shares" of E-SOL stock to unsuspecting investors and also taking money from people who thought they were buying land in a resort development near Cancun, Mexico, the indictment states.

The indictment also claims Ballow moved in 2008 to Puerto Aventuras, Mexico, where he lived in an expensive house facing the Caribbean Sea, but he disappeared from there in July 2009 just days after convincing a Texas investor to wire transfer $5 million from a bank in The Woodlands to E-SOL in Reno, Nev.

In October 2009, Ballow reappeared in Puerto Vallarta, Mexico, where he lived at a luxurious golf resort. The FBI and Mexican federal police arrested him there Tuesday.

Multiple pseudonyms
Ballow lived under the pseudonyms John Gel, Tom Brown, Marty Twinley and "Bubba," among other names, during his time as a fugitive, the indictment alleges. He also acquired a British passport in the name of Melvyn John Gelsthorpe.

As recently as May, using the pseudonym of Marty Twinley, Ballow sent an e-mail about arrangements to purchase a hotel in Puerto Vallarta in return for Aztec/Ultimate Lifestyles stock, authorities allege.

If convicted of the new charges, Ballow could face as many as 20 years in federal prison and a fine of as much as $250,000.

I like the share structure on AZTC...have quite a few shares...but played it up and down on that unexplained spike. Hoping to get a good RM partner on this one.
